Mortgage Deed

To all People to whom these Presents come – Greeting

Know ye that I Henry Peters of Hebron in Tolland County and State of Connecticut for the consideration of one hundred and twenty-six dollars and seventy-eight cents received to my full satisfaction of Horace Peters of Said Hebron

Do give, grant, bargain, sell and confirm unto the said Horace a certain tract of land in said Hebron bounded as follows – On the North by Turnpike Road, on the south and West by William P Gilbert land. And on the east by Sylvester G Gilberts land containing about five acres of land more or less with the buildings thereon standing

To have and to hold, the above granted and bargained premises, with the appurtenances there of unto him the said Horace, his heirs and assigns for ever to his and own proper use and behoof, And also I, the said Henry do for myself and heirs, executors, and administrators covenant with said Horace his heirs, assigns, that at, and until the ensealing of these presents, I am well seized of the premises, as a good and indefeasible estate in fee simple, and have good right to bargain and sell the same in manner and form as is above written, and that the same is free from all incumbrances whatsoever.

And furthermore, I the said henry do by these presents, bind myself and my heirs forever to warrant and defend the above granted and bargained premises to him the said Horace his heirs and assigns, against all claims and demands whatsoever.  Nevertheless this deed is upon condition that whereas I have this day made and executed a Note for the sum of one hundred and twenty-six dollars and seventy-eight cents, payable to said Horace Peters on demand and interest. __ if I shall well and truly pay said Note according to the tenor then this deed shall be void otherwise stand in full force and virtue in the law.

In witness whereof, I have hereunto set my hand and seal this 5th day of April in the year of Lord 1851

Know all men by these presents that I Pliny Parker of Hebron in the county of Tolland Administrator on the estate of Henry peters late of Hebron deceased by virtue of an order of Court of Probate for the district of Hebron dated March 9, 1863 authorizing and directing me to sell at Public Auction so much of the real estate  of the said henry Peters deceased as shall be sufficient to raise the sum of one hundred eighty six dollars and fifteen cents being the amount of debts and damages against the said estate exceeding the value of the personal estate with incidental charges and in consideration of the sum of thirty eight dollars and cents received to my full satisfaction of Horace Peters of said Hebron in Tolland County do grant, bargain sell and confirm unto the said Horace Peters all rights title interest claim and demands which the said Henry Peters had as the time of his decease in and to the following described real estate being the equity of redemption in the same all of which  is incumbered by the right of dower of the widow of said decease said real estate consists of a tract of land containing five acres mor or less with buildings thereon standing bounded northerly by highway Easterly by land of Horace peters Southerly and Westerly by lands of Sylvester G. Gilbert and George Force being all the real estate the said deceased did possess of subject to his widow’s right of dower as above stated.

To have and to hold the said granted and bargained [remises with the appurtenances thereof unto him the said Horace Peters and to his heirs and assigns to him and their own proper use and benefit forever and I the said Pliny Parker Administrator as aforesaid do hereby covenant with him the said Peters and his heirs and assignes that I have full power and authority as Administrator aforesaid to grant and convey the described premises in manner and form aforesaid and for myself and my heirs executors and administrators do further covenant to warrant and defend the same to him the said Horace Peters and his heirs and assignes against the claims of any person or persons over claiming by from or under as Administrator aforesaid for witness where of I have herewith set my hand and seal this 19th day of March A.D. 1863
